Is Vista really a name MS should be fighting for? Its not a very good name in my opinion, they're better off nameing it something else...like Windows 360

I think Vista is a fine name. It's time they got away from numbering and acronyms.

They were also taken to court by Real (aka RealPlayer) for their media player (some violation or whatever). Microsoft turned around and baught Real and stopped the proceedings

I don't thinck the sue is revelent. "Vista" is not its own operating system "Windows" is, and thus not its own company. Have you ever seen a Music album created by two bands that have the same album name? Yup! Is it against the law? Nope!

It would depend on the trademark. Since 'Vista' in this case would refer to software then it might be infringing. Sueing for 'Vista' being a car company for example wouldn't make sense, but since they are in similar categories then it is relevant.

Just because 'Vista' is a... erm... 'version name' of Windows doesn't mean it doesn't apply.
